Thread: Does anyone here know anything about Labor Laws, or any work or employment laws?

    Well the reason why I am asking is I think people are getting done wrong at my place of employment.Well for one, like myself, I have vacation time and my employers are refusing it when I ask them for it. Is this legal? Also when people have sick time and personal days, and they call in sick they are also being told they have to come to work sick or not. And to put the poopy icing on the cake, last week this Nursing assistants house burnt down to the ground, she had nothing left, she tried to call in and they said they are refusing her call in and she needs to come to work, Im am being totally honest, these people are evil and have no compassion or heart.Im wondering if there is something we can do about this, this is just getting out of hand. Can someone tell me if anything can be done?
    I just want out of the 200 weight range.

    Ginny I am sorry to hear that those things are going on and it doesn't sound quite legit.

    I have worked for attorneys that did just a little employment law. Every state has subtle differences in law but there are federal laws as well, so I cannot specifically answer your questions.

    However, I recommend you contacting your local "wage and hour" office, it will be listed under federal government listings in the phone book, or call an employment law attorney. Many will talk to you on a consultation basis without charging you a fee.

    It is true the laws vary by state. Try looking on the internet to see what you can find as well. I know for the state of Washington they pretty much allow employers to do what they want. Vacation and sick time are a benefit, therefore there is no law against your employer denying you ability to use it (In Washington anyway). There is however a law that protects your family rights. If you need to use sick or vacation to take care of your hubby/wife or kids I know they have to allow it. I believe that is a federal law that applies to all states, but don't quote me on that.     Ginny - more info is needed, please. Unfortunately you are in a profession that is designated as one that can be exempt from some laws that govern most work places. For example, if you ask for a vacation day but your absence would understaff your department, they can turn it down. Sorry, kiddo. That is not to say that your supervisors are not using that exemption power unfairly, and there are certainly some things that you can do.

    You may want to get started at the Department of Labor page concerning workplaces (there is a link to your local department as well) and read up on what the feds say about that - just click! There are some differences if work for a state facility or if you are protected by a union. I would be glad to help you find a solution if you give me a bit more info.
